The Central Bank of Malta is established by
the Central
Bank of Malta Act (Cap. 204) (‘the Act’), and operates under
the Act, the Statute
of the European System of Central Banks (the ‘ESCB Statute’),
as well as the relevant provisions of the Treaty
establishing the European Community (the ‘EC Treaty’).
This section contains a summary
of the Act, together with links
to all subsidiary
legislation and directives issued
under the Act, as well as to external
transactions circulars and forms issued by the Bank under
articles 23 and 24 of the Act in respect of article 8 of the
External
Transactions Act (Cap. 233).
The Bank also operates in terms of the legal framework of the
European System of Central Banks. Much of this framework is directly
applicable and has the force of law within Malta. Further information on this
framework
may be obtained from the website of the European
Central Bank.
The adoption and use of the European single
currency in Malta is primarily governed by European law. In
particular, the following
legal acts are applicable and have the force of law in Malta:
The Central Bank of Malta has published
a
study on European monetary law and the law of the euro, including
the laws made reference
to above, as applicable within Malta. This study is intended
primarily as a source of reference for researchers and legal
practitioners.
The Euro
Adoption Act (Cap. 485) complements
this legislation as required and provides for certain rules
applicable only to the changeover in Malta. Subsidiary legislation
prepared by the National
Euro Changeover Committee and issued
under this Act consists of the Smoothing of Monetary Amounts
Regulations (L.N.
369 of 2007), the Euro Adoption (Dual Display
and Euro Pricing) Regulations (L.N.
4 of 2007), and the Cash
Changeover Regulations (L.N.
441 of 2007).
